CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: February 8, 2011
Present: Richard Andrus, Timothy Lovett, Christopher Blair and Betty Pixley
The meeting convened at 6:10p.m.
Heller – RDA – 10 Riverwood Way – construct screened porch and extend wood deck (R. Andrus is the project manager)
Howard Burns representative for Mr. Heller was present to review the project. The Commission approved the project as submitted as a N2.
Mensi – NOI 230-0258 – 18 Sylvan Rd – demolish an existing house, rebuild with garage, associated sitework and septic upgrade (C. Blair is the project manager)
Shannon Boomsma of White Engineering and Robert McMahon, Architect were present to review the project. There is an existing home there (pictures were provided). The Mensi’s would like to demolish the house and rebuild with a garage. There are two wells and a septic already on the property. The electric will now be underground. There will be a new jet bat septic system installed. This project has received a special permit from the Zoning Board of Appeals and conditional approval from the Board of Health. If a new well needs to be drilled, the applicant will return to the Con Comm with those plans. The Commission approved the project as submitted with additional conditions.
Rissman – RDA – 48 Tyringham Rd – remove seven trees inside the 100’ buffer (T. Lovett is the project manager)
Jordan Richard (employee of John Fields) was present to review the project. They would like to burn the brush piles and leave log butts . The Commission approved the project as a N3 with the condition that a site visit is required with the contractor prior to any cutting/burning. Stumps will remain.
For Discussion:
1. Mail was reviewed.
2. Members of New England Keswick and Annecharico Construction came in at the request of the Commission to discuss a possible violation reported when some digging was recently done on the property near a brook without Commission approval. The Commission received quite a few complaints about this project. Annecharico stated that a water pipe burst and a new line needed to be dug. Annecharico stated that Peter Kolodziej gave him the ok to go ahead. Annecharico also stated that he contacted dig safe and received a trenching permit from the building department. DEP considers the body of water a river.
3. Pam Johnson of 140 Main Rd came in to request to remove some pine and ash trees on the property (stumps will remain). She wanted to confirm that they were not required to file officially. The property has frontage on Stevens Lake but the cutting proposed will be several hundred feet from the lake. The Commission determined that the cutting does not fall under their jurisdiction.
4. Jeff Purvis came in with questions about removing trees on his property which is located near Keswick. The area is located in the SMA area. The Commission stated that a letter detailing the work to be done, if the stumps are to be removed and a sketch of the area would be appropriate right now since the amount of trees to remove are minimal.
5. An Enforcement Order was issued to Louis & Claire Rigali for a landing created for a logging operation that was placed in a BVW off Harmon Rd and Gould Rd. The Commission will hold an interim meeting on 2/22 to further discuss this with the property owner and logger.
6. The Board reviewed submitted cutting plans regarding some logging that has been occurring on Beartown Mtn Rd. We reviewed the permit for logging on Beartown Mt Rd. and determined, in general, that they had a proper permit and the landing was about where it was supposed to
be. It was a very through submission to DCR.
7. Concerned citizens provided the Commission with information on “electrosmog” and its effects to consider with regards to the Planning Board’s proposed changes to the Telecommunication’s bylaw. The Commission will look the material over but unless a tower is proposed to be constructed in our jurisdiction the Commission would not have any authority.
8. Rick was asked by the Fire Dept. about how much regulations and permitting were required for fire ponds. Chris pointed Rick to the appropriate section of the wetlands regulations and noted that a Notice of Intent should be filed by Monterey considers these projects on a site to site basis.
